These Terms of Use (“Terms”) govern your use of the website located at https://newmexicodatainsights.com (the “Site”). The Site is operated by New Mexico Data Insights, LLC (“New Mexico Data Insights,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who We Are and What We Do

The Site is primarily intended to provide information about our services and allow data brokerage services, which focus on property records and related public information used by real estate professionals, title companies, financial institutions, and other organizations with legitimate business needs. The Site also allows individuals to submit privacy-related requests regarding their personal information.

2. Eligibility and Your Responsibilities

You may use the Site only if you are at least 18 years old (or the age of majority in your jurisdiction), and use the Site for your own personal, non-commercial purposes and in compliance, or if you are a business, organization, or professional (such as a real estate broker or similar entity) using the Site for lawful commercial purposes consistent with these Terms and applicable law. Under the Fair Credit Reporting Act (“FCRA”), 15 U.S.C. 1681 et seq., property records and other public records reports may not be used, in whole or in part, as a factor in any of the following: (a) establishing a consumer’s eligibility for credit; (b) employment screening or hiring decisions; (c) tenant screening or rental housing decisions; (d) insurance underwriting; or (e) any other purpose that would make such information a “consumer report” under the FCRA. Use of information from those sites for any FCRA-regulated purpose is strictly prohibited.

You agree not to:

  • Use the Site in any way that violates applicable law or infringes the rights of others.
  • Attempt to interfere with the operation or security of the Site.
  • Use the Site to submit false, fraudulent, or malicious requests.

3. Privacy

Our Privacy Policy explains how we collect, use, and disclose information when you use the Site or submit a privacy request. Please review it carefully before using the Site.

4. Site Content and Use

4.1 License

All content on the Site, including text, graphics, logos, and other materials, is owned by or licensed to New Mexico Data Insights and is protected by law.

We grant you a limited, non-exclusive, revocable license to access and use the Site for lawful, personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works from the Site or its content, except as allowed by law or with our prior written permission.

4.2 No Legal or Professional Advice

The Site does not provide legal, financial, or professional advice. Any information on the Site is for general informational purposes only.

4.3 Abusive or Fraudulent Requests

Our goal is to make it easy for individuals to exercise their privacy rights with respect to the personal information we maintain in connection with our data brokerage services, which primarily consist of property records and related public information. We will review and respond to verifiable privacy requests as required by the California Consumer Privacy Act (as amended by the CPRA), the California Delete Act, and other applicable laws. While our data holdings focus on property and related public records, to the extent we maintain other categories of personal information subject to applicable law, those records are also covered by this process.

However, we are not required to process requests that are fraudulent, not made by or on behalf of a consumer, or “manifestly unfounded or excessive,” including because of their repetitive character. Where we reasonably determine that requests fall into one of these categories, we may:

  • Decline to act on the request, or
  • Narrow the scope of the request, or
  • In limited circumstances permitted by law, charge a reasonable fee based on our administrative costs.

When we decline or narrow a request on this basis, we will explain our reasons as required by law.

4.4 Authorized Agents

Consumers may choose to use an authorized agent to submit privacy requests on their behalf, as permitted by applicable law. We may require an authorized agent to provide proof of their authority to act for the consumer, and we may ask the consumer to confirm that they granted that authority when allowed by law.

We also accept requests from Commercial Authorized Agents — businesses that submit privacy requests on behalf of multiple consumers as part of their commercial services. Commercial Authorized Agents must comply with our reasonable verification and documentation requirements.

Any Commercial Authorized Agent represents and warrants that: (a) it has all permissions, consents, and authority necessary to submit each request on behalf of the consumer; and (b) the information it provides to us is accurate and not misleading. To the extent permitted by law, each Commercial Authorized Agent agrees to defend, indemnify, and hold harmless New Mexico Data Insights, LLC from and against any third-party claims, damages, losses, or expenses (including reasonable attorneys’ fees) that arise out of the Commercial Authorized Agent’s violation of these representations, the Terms, misuse of a consumer’s personal information, or fraudulent or unauthorized submission of requests.

Nothing in this subsection limits any rights consumers have under applicable privacy laws, or our obligations to respond to valid, verifiable privacy requests.

5. No Fees; No Third-Party Advertising

The Site does not process payments and does not host third-party advertising. If this changes in the future, we will update these Terms and/or provide additional terms to you.

6. Changes to the Site and These Terms

We may update or change the Site from time to time, and we may update these Terms as needed. When we do, we will change the “Last Updated” date above. If you continue using the Site after the Terms are updated, you accept the updated Terms.

7. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DO NOT MAKE ANY PROMISES OR WARRANTIES ABOUT THE SITE, INCLUDING THAT IT WILL BE ERROR-FREE OR UNINTERRUPTED.

Some jurisdictions do not allow limitations on implied warranties, so some of the above may not apply to you.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEW MEXICO DATA INSIGHTS AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL BE LIMITED TO THE AMOUNT YOU PAID TO US IN CONNECTION WITH THE SITE IN THE 12 MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

9. Dispute Resolution and Arbitration

Most concerns can be resolved quickly by contacting us. If we cannot resolve a dispute informally, you and we agree to resolve it through binding arbitration as described below.

9.1 Agreement to Arbitrate

You and New Mexico Data Insights agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site (collectively, “Disputes”) will be resolved by binding arbitration on an individual basis, rather than in court, except that:

  • You or we may bring an individual action in small claims court if the claim qualifies; and
  • You or we may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent or stop actual or threatened infringement, misappropriation, or violation of intellectual property or proprietary rights.

You and we agree that the JAMS Consumer Arbitration Minimum Standards and the JAMS Consumer Arbitration Rules will govern the arbitration, as modified by these Terms.

9.2 Arbitration Procedures

  • The arbitration will be administered by JAMS. You can find JAMS’ rules and information on how to file at https://www.jamsadr.com.
  • The arbitration will be conducted by a single, neutral arbitrator.
  • The arbitration hearing (if any) will take place in or near Albuquerque, New Mexico, unless you and we agree otherwise or the arbitrator requires a different location.
  • If the JAMS Consumer Arbitration Rules would require a different, consumer-friendly location (for example, a hearing by video or in your home state), we will follow those rules.

The arbitrator will have the authority to award any relief that would be available in court under law or in equity, consistent with the limitations in these Terms.

9.3 No Class or Representative Actions

To the fullest extent permitted by law, you and we agree that:

  • Disputes will be resolved only on an individual basis;
  • Neither you nor we may bring a claim as a plaintiff or class member in a class, consolidated, or representative action; and
  • The arbitrator may not consolidate the claims of more than one person or otherwise preside over any form of class, consolidated, or representative proceeding, except in accordance with JAMS’ Mass Arbitration Procedures.

If any part of this “No Class or Representative Actions” subsection is found unenforceable as to a particular claim or remedy, then that claim or remedy (and only that claim or remedy) will proceed in court and be stayed pending arbitration of the remaining claims.

9.4 Opt-Out

You may choose to opt out of this agreement to arbitrate by sending us written notice within 30 days of the date you first accept these Terms. Your opt-out notice must include your name, contact information, and a clear statement that you wish to opt out of arbitration with New Mexico Data Insights, and must be sent to:

10. Governing Law and Venue

These Terms and any Dispute between you and us will be governed by the laws of the State of New Mexico and the United States, without regard to conflicts-of-law rules.

For any Dispute that is not subject to arbitration or that may be brought in court under these Terms, you and we agree that the state and federal courts located in Albuquerque, New Mexico will have exclusive jurisdiction and venue.
